Terms of Use
These terms govern the use of the Lebsa app and the lebsa.ly website (together, the “Service”). By creating an account or using the Service you accept these terms and the Privacy Policy. If you do not agree, please do not use the Service. The Arabic version prevails if the two versions differ.
1. What Lebsa is
Lebsa is a platform that connects customers with clothing shops in Libya to rent and buy clothes, and gives shops tools to run their business. A rental or sale is between the customer and the shop directly; the shop is responsible for its pieces, their quality, prices, terms and handover. Lebsa is not a party to that agreement, but we try to help both sides resolve any dispute.
2. Your account
- You must be at least 18 and use a phone number you own.
- You are responsible for keeping your password secret and for everything done through your account, and must tell us immediately if you suspect unauthorised use.
- The information you give must be accurate and up to date.
- You can delete your account at any time as described on the Delete account page.
3. Booking and buying (customers)
- A booking is a request to the shop and is confirmed only once the shop accepts it, or automatically if the shop has turned on automatic acceptance.
- Prices, deposits, security amounts, rental periods and return and cancellation terms are set by each shop and shown before booking; sending the request means accepting them.
- You must collect and return the piece at the agreed times and in the condition you received it, and pay the late or damage fees set out in the shop's terms shown before booking.
- Repeated no-shows or late cancellations may lead the shop or Lebsa to restrict your bookings.
- Payment is in cash to the shop, or by card through the payment provider where available. For card payments, Lebsa receives the amount on the shop's behalf and transfers it to the shop under the settlement terms. Refunds follow the shop's terms and the payment method.
4. Shops
- A shop must keep its information, products, photos and prices accurate, and must have the right to display, rent or sell them.
- A shop must fulfil the bookings and orders it accepts, honour its stated terms, and comply with the laws of Libya.
- Customer data a shop sees may be used only to fulfil bookings and orders and serve that customer; it must not be sold or used for other purposes without the customer's consent.
- The shop owner is responsible for their staff and branches and the permissions they grant.
- We may ask for documents to verify a shop, and may refuse or suspend a shop that does not meet verification requirements.
5. Subscriptions and fees
Lebsa is free for customers. Shops use the Service on a subscription, according to the plans and prices shown in the app; a free trial may be offered as announced in the app. Subscriptions renew under the plan's terms, and shop features may be limited if the subscription is unpaid. Fees paid are non-refundable unless the plan says otherwise or the law requires it. Additional paid services, such as promotion, follow the terms shown at purchase.
6. Content
Content you add (photos, reviews, messages, products) remains yours, and you grant Lebsa a free, non-exclusive licence to display and process it as needed to run the Service, and to show publicly posted content (such as products and reviews) within the Service and in promoting it. Private messages are never used in promotion. You must not post content that:
- is unlawful, indecent, offensive or misleading;
- infringes others' rights or privacy, including posting their data or photos without permission;
- contains unrelated advertising or links, or fake reviews.
We may remove content that breaks these rules, and you can report any content from within the app.
7. Prohibited use
- Attempting unauthorised access to accounts or systems, disrupting the Service, or scraping its data.
- Impersonating a person or shop, or creating fake accounts.
- Using the Service for fraud or any unlawful activity.
8. Suspension and termination
Lebsa may suspend or close any account or shop that breaks these terms or puts users or the Service at risk, informing its owner where possible. Obligations incurred before termination remain.
9. Limitation of liability
The Service is provided “as is”. We work to keep it available and accurate but do not guarantee it will be uninterrupted or error-free. To the extent permitted by law, Lebsa is not liable for the pieces shops offer or their quality, for shops' performance of their obligations, or for indirect losses arising from use of the Service. This exclusion does not cover fraud or gross negligence by Lebsa.
10. Governing law
These terms are governed by the laws in force in the State of Libya, and Libyan courts have jurisdiction over any dispute, after an attempt to settle it amicably.
11. Changes and contact
We may change these terms. The new version is published here with its date, and we notify users in the app of any material change. Continuing to use the Service after a change means accepting it. Contact: [email protected].
